Implementation of Chapter 3 of the DSM Directive in Finland

1. Minimalistic approach in national implementation
By implementing the DSM Directive (EU 2019/790) Finland adopted four new provisions in the Finnish Copyright Act (FinnCopAct) (originally from 1961 with numerous amendments until 2024) about following specific topics:

Right to appropriate and proportionate remuneration (Section 28 a),

The adjustment of an unreasonable condition in an agreement on a transfer of copyright (Section 29),

Reporting of the exploitation of a work (Section 30 a), and

Revocation of a transfer of rights (Section 30 b)
